One of the essential provisions of various Acts is that an entrepreneur who runs or establishes any industry or process and discharges effluent or emits pollutants into any water resource, land, or air, and thereby pollutes the environmental water or air, is required to obtain consent.
The entrepreneur needs to obtain consent in two phases to ensure compliance with the regulations and prevent any harmful environmental effects
- MPCB Consent to Establish –
This consent is to be obtained prior to establishing any industry or process. The validity of MPCB consent to establish is up to 5 years or up to commissioning of the unit. - MPCB Consent to Operate –
This consent is to be obtained before starting any production or activity. The validity of MPCB consent to operate depends upon the pollution index criteria set by CPCB and MPCB. - MPCB Consent to Renewal –
The Consent is to operate is given for a particular period which need to be renewed regularly.
